HOSPITALITY AGREEMENT AND GENERAL BOOKING CONDITIONS

Art. 1. COMPANY DETAILS

The Company carries out Property Management activities and manages properties on behalf of third parties, coordinating reservations, guest assistance and services connected with the stay.

Art. 2. RECITALS

These General Conditions govern the relationship between BT Consulting SRLS, Matchome, and the guests of the managed properties. Confirmation of the booking implies full acceptance of this agreement. This document supplements the booking confirmation, the property listing, the house guide and any communications sent by Matchome.

Art. 3. DEFINITIONS

• Property Manager: BT Consulting SRLS, manager of the property services.
• Owner: The owner of the property or other entitled party.
• Guest: The person making the booking and all persons included in the booking.
• Property: The residential unit subject of the stay.
• Matchome Services: Assistance, coordination, check-in, check-out, cleaning and ancillary services.

Art. 4. SUBJECT OF THE AGREEMENT

BT Consulting SRLS acts as Property Manager and not as owner of the property, unless otherwise indicated. The Company coordinates the promotion of the property, the management of bookings, the relationship with guests, check-in and check-out, guest registration, the coordination of cleaning, laundry, ordinary maintenance and any additional services requested.

Art. 5. PRICE COMPOSITION

The total amount of the booking may include:

• rent due to the owner;
• fee for Property Management services;
• cleaning costs;
• tourist tax, where applicable;
• any additional services requested by the guest.

The individual items are shown in the booking confirmation or on the portal used.

Art. 6. ACCEPTANCE

By confirming the booking, the Guest declares that they have read, understood and fully accepted this agreement and undertakes to comply with the rules of the property and the operating instructions communicated by Matchome.

Art. 7 – Booking methods

The booking may be made through the Matchome website, online booking platforms such as, by way of example, Airbnb, Booking.com and similar portals, or directly with BT Consulting SRLS. The booking shall be considered completed only upon receipt of written confirmation and any required payment. Matchome reserves the right to refuse bookings with incomplete, inaccurate or potentially fraudulent data.

Art. 8 – Booking fee

The total price of the stay is determined by the sum of the rent, the Property Management services provided by Matchome, cleaning costs, any tourist tax and any additional services requested. The detailed amount is shown in the booking confirmation or on the portal used.

Art. 9 – Payment methods

Payments must be made according to the methods and deadlines indicated in the booking channel. Any amounts due during the stay, such as extra services, security deposits or tourist taxes, must be paid within the deadlines communicated by Matchome.

Art. 10 – Security deposit and damages

For some properties, a security deposit may be required as a guarantee for the proper use of the property. The amount and return methods will be communicated before the stay. In the event of damage, missing items, violations of the rules or extraordinary expenses attributable to the guest, Matchome may retain the amount in whole or in part, without prejudice to any greater damage. Any damage, missing items or anomalies found during cleaning, maintenance or inspection of the property, even if detected after check-out, may be disputed to the guest within 7 days of departure by means of photographic documentation, video or other suitable evidence.

Art. 11 – Additional services

Upon request and subject to availability, Matchome may organize ancillary services such as airport transfers, luggage storage, additional cleaning, linen change, tourist experiences, rentals and other services. Each service must be confirmed in writing and shall be subject to the relevant fee.

Art. 12 – Booking changes

Requests for changes are subject to the availability of the property and to the conditions applied by the booking channel used. Matchome does not guarantee the possibility of changing dates, number of guests or duration of the stay after confirmation of the booking.

Art. 13 – Check-in

Ordinary check-in is available from 3:00 p.m., unless otherwise communicated. The time may be changed exclusively by Matchome for organizational or operational needs. Early access does not constitute a right of the guest.

Art. 14 – Guest registration

Pursuant to current Italian legislation, all guests, including minors where required, must be registered before access to the property by means of a valid identity document. Failure to send the required documentation may result in refusal of check-in until the legal obligations have been fulfilled.

Art. 15 – Self check-in and access codes

Where provided, check-in takes place by means of a key box, keypad, QR Code or other electronic system. Codes, keys and credentials are strictly personal, may not be transferred to third parties and must be kept with due care. Any improper use remains the responsibility of the guest. BT Consulting SRLS may document the condition of the property before check-in and after check-out by means of photographs or videos exclusively for contractual protection purposes and for the management of any disputes.

Art. 16 – Obligations upon arrival

The guest is required to check the condition of the property upon entry and to promptly report any anomalies or pre-existing damage. In the absence of reports, the property is presumed to have been delivered in perfect maintenance and cleaning condition.

Art. 17 – Early check-in and late check-out

Early check-in and late check-out are granted only upon written confirmation from Matchome. Availability depends on the absence of immediately preceding or subsequent bookings and on the time required for cleaning. Where authorized, they may be subject to an additional fee communicated in advance.

Art. 18 – No-show

In the event of a significant delay or failure to arrive, the guest must promptly inform Matchome. In the absence of communication, check-in assistance at the requested times cannot be guaranteed, without prejudice to the obligations arising from the confirmed booking.

Art. 19 – Maximum number of guests

Access and overnight stay are permitted exclusively to guests indicated in the booking and duly registered. The maximum number of occupants is the one indicated in the property listing. It is forbidden to host unauthorized persons without prior written approval from Matchome. The entry or overnight stay of unregistered persons constitutes a serious contractual breach and may result in the immediate termination of the stay, in addition to the charging of any penalties, costs or damages suffered by BT Consulting SRLS or by the owner.

Art. 20 – Minors

Minors must be accompanied and constantly supervised by a responsible adult. Matchome and the owner assume no responsibility for damage or accidents resulting from lack of supervision.

Art. 21 – Pets

Pets are allowed only in properties where this is expressly indicated. The guest is responsible for any damage caused by animals and for compliance with hygiene and condominium rules.

Art. 22 – No smoking, parties and disturbing behavior

Unless otherwise indicated, smoking is prohibited inside the property. Parties, events, noisy activities and any behavior that may disturb the neighborhood or violate condominium rules are prohibited. Matchome may request the immediate cessation of the violation and, in the most serious cases, early termination of the stay without any right to a refund.

Art. 23 – Diligent use of the property

The guest undertakes to use the property, furnishings, appliances and all equipment with the utmost diligence, avoiding improper use and promptly reporting any faults or malfunctions.

Art. 24 – Separate waste collection and rubbish

The guest is required to comply with the separate waste collection methods established by the Municipality and with the instructions contained in the house guide. Any costs incurred due to non-compliance with the provisions may be charged to the guest.

Art. 25 – Swimming pools, gardens and outdoor areas

Where present, swimming pools, gardens, terraces, courtyards and outdoor spaces must be used with the utmost diligence and in compliance with the rules of the property and any condominium regulations. Use takes place under the exclusive responsibility of the guest, with particular attention to minors, who must be constantly supervised by an adult. The guest uses the property, appurtenances, swimming pools, gardens, terraces, balconies, parking spaces and common areas under their own responsibility and holds BT Consulting SRLS and the owner harmless from any liability arising from improper, imprudent use or use contrary to the instructions received, without prejudice to cases mandatorily provided for by law.

Art. 26 – Garages, parking spaces and parking areas

The use of garages, boxes or parking spaces is permitted only if included in the booking or expressly authorized. Matchome is not responsible for theft, damage or events occurring to vehicles left in parking areas, except in cases mandatorily provided for by law.

Art. 27 – Systems, appliances and equipment

The guest is required to correctly use all systems, appliances and equipment present in the property, following the instructions provided. It is forbidden to tamper with electrical, plumbing, air conditioning, heating systems or safety devices.

Art. 28 – Wi-Fi and technological services

Any internet connection is provided as an ancillary service. BT Consulting SRLS does not guarantee continuity of the service and is not liable for interruptions due to telephone operators, connectivity providers or force majeure. The guest undertakes to use the network in compliance with current legislation.

Art. 29 – Consumption and responsible use

The guest undertakes to use water, electricity, gas, air conditioning and heating responsibly, avoiding waste. Upon departure, air conditioners, lights and electrical appliances must be switched off, and doors and windows closed, unless different instructions have been received.

Art. 30 – Keys, badges, remote controls and access devices

Keys, badges, remote controls, QR Codes, numerical codes and any other access devices must be kept with the utmost care. Loss or damage may result in the charging of the costs necessary for replacing locks, duplicating keys, reprogramming devices or other necessary interventions.

Art. 31 – Guest responsibility

The guest is responsible for the proper custody of the property, furnishings, equipment and appurtenances for the entire duration of the stay. The guest is also responsible for the behavior of the persons included in the booking and of any authorized visitors. BT Consulting SRLS is not responsible for theft, loss, deterioration or removal of money, valuables or personal belongings left in the property during the stay, except in cases of willful misconduct or gross negligence.

Art. 32 – Damage to the property

Any damage caused to the property, systems, furnishings, appliances, equipment, keys or common areas must be immediately reported to Matchome. Repair or replacement costs will be charged to the guest on the basis of the costs actually incurred, without prejudice to compensation for any greater damage.

Art. 33 – Faults and maintenance

The guest is required to promptly report any fault or malfunction. BT Consulting SRLS undertakes to coordinate interventions as quickly as possible, compatibly with the availability of technicians and the nature of the problem. Access to maintenance personnel must be allowed upon reasonable notice, except in urgent cases. Matchome coordinates the interventions but does not guarantee repair times that depend on external technicians or on the availability of spare parts.

Art. 34 – Cleaning of the property

The property is delivered clean and tidy. At the end of the stay, it must be returned in decent condition. Ordinary cleaning is included where provided for in the booking; any extraordinary cleaning made necessary by improper use may be charged to the guest.

Art. 35 – Linen and household items

The linen provided is intended exclusively for use inside the property. It is forbidden to remove or use sheets, towels, blankets or other household items outside the property. Loss or damage will result in the charging of the relevant replacement cost.

Art. 36 – Forgotten items

Matchome is not responsible for personal items forgotten in the property. If found, they may be returned to the guest upon reimbursement of shipping and handling costs. Items not claimed within a reasonable period may be disposed of in accordance with current legislation.

Art. 37 – Limitation of Matchome’s liability

BT Consulting SRLS is not responsible for interruptions in the supply of water, electricity, gas, internet connection, telephone services or other services attributable to third parties, nor for force majeure events, natural disasters, measures by the Authorities or facts not directly attributable to the Company.

Art. 38 – Complaints

Any anomalies or disruptions must be reported to Matchome without delay and, in any case, within 24 hours of their discovery, so that the situation may be assessed and, where possible, an intervention arranged. Complaints made only at the end of the stay without prior notification may not be taken into consideration if they have prevented any possibility of verification or remedy.

Art. 39 – Cancellations and changes

The cancellation and change conditions of the booking are those indicated on the booking portal or in the contractual confirmation sent to the guest. Requests for changes will be evaluated depending on the availability of the property and do not constitute a right of the guest.

Art. 40 – Force majeure

BT Consulting SRLS shall not be liable for the impossibility of performing, in whole or in part, its obligations where this depends on force majeure events, natural disasters, measures by the Authorities, strikes, wars, pandemics, interruptions of public services or other unforeseeable and unavoidable events.

Art. 41 – Processing of personal data

The personal data of guests will be processed by BT Consulting SRLS, as Data Controller, in compliance with Regulation (EU) 2016/679, GDPR, and current Italian legislation, exclusively for purposes connected with the management of the booking, the performance of this agreement, legal obligations, including communication obligations to the competent Authorities, and the protection of the rights of the Data Controller. The complete privacy notice on the processing of personal data is made available to guests before the conclusion of the booking and on the company website, where present.

Art. 42 – Communications

Any communication between the parties may take place by email, messaging through the booking platform, WhatsApp or other tools used by Matchome, except in cases where the law requires a different form.

Art. 43 – Applicable law and competent court

This agreement is governed by Italian law. Any dispute shall be submitted to the Court identified by current legislation, without prejudice to the mandatory provisions for the protection of consumers.

Art. 44 – Entire agreement

This agreement, together with the booking confirmation, the property listing, the House Guide and any attachments, constitutes the entire agreement between the parties and replaces any previous understanding having the same subject matter.

Art. 45 – Partial invalidity

The possible invalidity or ineffectiveness of one or more clauses shall not result in the invalidity of the entire agreement. The remaining provisions shall continue to have full effect within the limits permitted by law.

Art. 46 – Reference to current legislation

For anything not expressly governed by this agreement, the provisions of the Italian Civil Code, Italian legislation on tourist rentals and consumer protection, as well as any other applicable legal provisions, shall apply.

Art. 47 – Specific approval of clauses

Pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, the Guest declares that they have read and specifically approve the clauses relating to: booking methods, payments, security deposit, check-in and check-out, guest responsibility, damages, limitations of liability, complaints, cancellations, force majeure, processing of personal data, competent court and any other clause that entails limitations of liability or obligations borne by the Guest.

Clarifications:

Art. 48 – Status of BT Consulting SRLS

BT Consulting SRLS acts as Property Manager and organizer of the services connected with the stay. Unless otherwise indicated in writing, the Company is not the owner of the property but acts in the interest of the owner for management, coordination, guest assistance and collection of the fees falling within its competence.

Art. 49 – Keys

Where, for security reasons, it is necessary to replace cylinders, electronic locks, remote controls or key boxes, the related costs shall be charged in full.

Art. 50 – Access in emergencies

In the presence of emergencies such as fires, gas leaks, flooding, system failures or situations that may cause damage to persons or property, Matchome and the appointed technicians are authorized to access the property without prior authorization from the guest.

Art. 51 – Video surveillance

Where video surveillance systems are present only in common or external areas, they operate exclusively for security purposes in compliance with the GDPR and current legislation.

Art. 52 – Violation of the rules

A serious violation of the house rules or of these conditions may result in the immediate termination of the stay without any right to a refund, without prejudice to compensation for any damages.

Art. 53 – Complaints and refunds

Any request for a price reduction or refund presupposes the timely reporting of the problem and the concrete possibility for Matchome to intervene. Otherwise, the request may be rejected.

Art. 54 – Interruption of services

Temporary interruptions of water, energy, internet, air conditioning or other services depending on third-party suppliers or force majeure do not constitute a breach by Matchome, except as provided by mandatory rules.

Art. 55 – Restoration and sanitization

Where extraordinary cleaning, sanitization, pest control or restoration interventions become necessary due to non-compliant use of the property, the related costs shall be charged to the guest.

Art. 56 – Documentary evidence

Photographs, videos, access system records, messages on platforms and maintenance reports may be used as evidence of facts relating to the stay within the limits permitted by law.

Art. 57 – Mediation

Before initiating litigation, the parties undertake to seek an amicable solution by written communication.

The Guest declares that they have read, understood and fully accepted this agreement.
